1. The service
1% Better is an accountability, journaling and AI-coaching application provided by One Percent Edge AI. We may add, change or remove features over time.
2. Eligibility
You must be at least 16 years old and able to enter a legally binding contract. If you use the service on behalf of an organisation, you confirm you are authorised to bind that organisation.
3. Your account
- You are responsible for activity under your account and for keeping your credentials secure.
- You agree to provide accurate information.
- You must notify us of any unauthorised access.
4. Your obligations
You agree not to misuse the service. The full list of prohibited behaviour is in our Acceptable Use Policy.
5. Intellectual property
- The 1% Better software, design, brand and content are owned by One Percent Edge AI.
- You retain ownership of your content (journals, goals, habits, notes). See our User Content Policy.
- You grant us a limited, worldwide, royalty-free licence to host, process and display your content solely to operate the service for you.
6. AI output
AI-generated responses are produced by automated systems and are provided for educational and accountability purposes. See our AI Advice Disclaimer. You are responsible for the decisions you make based on AI output.
7. Subscriptions, billing and refunds
Paid plans are billed in advance on a recurring basis. Cancellation, renewals and refund rules are set out in our Subscription & Refund Policy, which forms part of these terms.
8. Service availability
We aim to keep the service available but do not guarantee uninterrupted access. We may carry out maintenance, change features or temporarily suspend the service to protect users or the platform.
9. Termination
- You may cancel and delete your account at any time.
- We may suspend or terminate your account if you breach these terms, our Acceptable Use Policy, or applicable law, or to protect other users.
- On termination, your right to use the service ends. Sections that should reasonably survive (intellectual property, liability, governing law) will continue.
10. Limitation of liability
Nothing in these terms limits liability that cannot lawfully be excluded, including death or personal injury caused by negligence, fraud, or your statutory rights as a consumer under the Consumer Rights Act 2015.
Subject to that, to the maximum extent permitted by law:
- We are not liable for indirect, consequential or special losses, lost profits, lost revenue, lost data or loss of goodwill.
- Our total aggregate liability in any 12-month period will not exceed the greater of (a) the fees you paid us in that period, or (b) £100.
11. Indemnity
You agree to indemnify One Percent Edge AI against third-party claims arising from your misuse of the service or your breach of these terms, except where prohibited by law.
12. Changes to the terms
We may update these terms. Material changes will be notified by email or in-app. Continued use after the effective date means you accept the updated terms.
13. Dispute resolution
If a dispute arises, please contact us first at hello@onepercentedgeai.com so we can try to resolve it. If we cannot resolve it informally, disputes are subject to the jurisdiction described below.
14. Governing law and jurisdiction
These terms are governed by the laws of England and Wales. The courts of England and Wales have non-exclusive jurisdiction, except that consumers may also bring proceedings in the courts of the country where they are resident.
